Terms and Conditions of Dance Lessons

Please be sure to read this document mindfully prior to booking. The terms of this agreement nullify anything that you may have been told by any other party regarding bookings with SENES Flamenco / Centro de Flamenco Melbourne and you.

These terms and conditions outline important information about registration and enrolment in dance classes online and in-studio at SENES Flamenco/Centro de Flamenco Melbourne. Please be sure to read this document mindfully before you join and if you have any questions please be sure to ask us prior to agreeing to these terms. The terms of this agreement nullify anything that you may have been told by anyone. If you have been told anything different to what is contained in this document then you should discuss this with us before agreeing to these terms. The terms and conditions of our studio may change from time to time and you will always be able to see the most up to date terms and conditions here.

1. Agreement

- When you purchase any dance class or service from us you agree to all the terms and conditions of this agreement.

- You agree that the information contained in this agreement outlines a complete agreement between you and us.

- If any part of this agreement becomes invalid or discontinued you agree that the remaining parts will continue to be valid.

- If SENES Flamenco/Centro de Flamenco Melbourne does not enforce its rights under this agreement that does not mean that we are waiving those rights. Our rights under this agreement may still be enforced.

2. Class Bookings and Cancellations

- For Private lessons and redemption of gift vouchers, cancellations can be made up to 24 hours prior to the start of your class to avoid a late cancel/absent fee. No extensions or refunds on gift vouchers can be made except in exceptional circumstances (death, terminal /severe illness, hospitalisation, severe accident / injury). Transfer requests must be made in writing.

1. Multi - Class Passes / Term Fees / Casual lessons

- Multi-class Passes and Terms will expire as indicated, no extensions are permitted except in exceptional circumstances (death, terminal /severe illness, hospitalisation, severe accident / injury). 

10 class passes to be used within 10 weeks. All term payments are paid in advance and make up lessons must be made within the term if options are available on alternative days. 

Casual lessons must be paid for on the day of the class taken including online lessons.

4. Access to the studio

- For student who are under 18 years, all registration and other administration forms must be provided by a parent or legal guardian prior to attending classes.

-minors must be accompanied to the studio entrance and picked up inside the property.

- It is recommended that if you have a pre-existing health condition, that you seek medical advice prior to undergoing any classes to ensure that flamenco dance is suitable for you.

- Leave your valuables at your own risk.

- Please be sure that you are wearing suitable attire for your classes. 

5. Use of studio facilities

- It is your responsibility to use our equipment and facilities with respect and care. If you are unsure of how to use anything please let the instructor know.

- It is our right to remove or replace any equipment.

- We reserve the right to change, cancel or delete classes from our schedule at our discretion without notice.

- We reserve the right to close the studio for periods of time whereby any prepaid classes will be extended.

-A respectful and courteous personal and public conduct amongst students and instructors, musicians and staff of all ages is required to participate in classes, events and activities organised by SENES Flamenco. Examples of inappropriate behaviour include: • verbal or physical intimidation; • harassment; • discrimination on the basis of race, sex, age or any disability another person may have We do not tolerate disrespectful behaviour and will escort any offenders from the premises or call the police if the situation is deemed unsafe to do so. 

-Parking at your own risk. We are not liable for any loss or damage to your vehicle or its contents.

6. Medical or physical conditions

- It is your responsibility to let us know if you have any medical or physical conditions that may affect your dance practice.

- It is your responsibility to ensure that you have permission from your doctor or treating practitioner to participate in our classes.

- By agreeing to these terms you accept that you have no detrimental medical or physical conditions that you are not aware of that may prevent you from participating in our classes.

- If your medical or physical condition changes after joining it is your responsibility to let us know.

- You accept that we are not medical practitioners and cannot give you any advice on your medical condition nor your ability to participate in our classes. If you have any doubts, we strongly urge you to seek expert advice before starting your physical activity.

7. Release

- You acknowledge that you have agreed to the liability waiver that was provided to you upon your initial registration for flamenco dance classes.

- You agree that practising dance in-studio and at home involves a risk of minor and major injury, soft tissue injury, broken bones and joint injuries and that you practise at your own risk.

- You agree to practise safely by use of appropriate footwear and approach lessons with a safe dance practise. 

- You agree that we will not be liable for any personal items that are damaged, lost or stolen.

- You agree that you will liable for costs of repairs and replacement of equipment damaged by yourself to any of our equipment.

8. Violation of rules and regulations

- It is our right to change or vary the above terms and conditions and our policies from time to time.

- Any violation of our terms gives us the right to terminate your registration and enrolment in current classes, effective immediately at our discretion.

- We reserve the right to refuse entry to anyone into the studio or to any classes for any reason.

- We reserve the right to cancel, terminate or suspend memberships or access to the studio to any student who breeches the above terms and conditions without warning or notice.

Terms and Conditions of Show Bookings

Please be sure to read this document mindfully prior to booking. The terms of this agreement nullify anything that you may have been told by any other party regarding bookings with SENES Flamenco and you. Any changes to terms and conditions will be made available on the wesbite at all times.

1. Terms of Bookings

- At the time of booking it is assumed you have read and agreed to all the terms and conditions.

- If any part of this agreement becomes invalid or discontinued you agree that the remaining parts will continue to be valid.

2. Booking Process & Payment

All bookings must be confirmed via email and a deposit paid to secure the booking and performer’s availability. 

Full fee is payable by the due date of invoices or as per prior agreement by the contractor; late payments of more than 7 days incur a late fee. If you are having financial difficulty please contact us in writing to organise payment options.

SENES Flamenco reserve all rights to cancel any bookings until a deposit is paid.

Requests for tax invoices must be given in advance with full details of contractor available.

3. Requests For Changes & Cancellations

All requests for cancellations, changes of date, time, venue and duration of show bookings must be made via email to SENES Flamenco. Reasons for entire show bookings cancellations must be accompanied by requests in writing.

Please be aware changes in show bookings may not be possible depending on performer’s availability. Cancellations due to change of mind or weather are not accepted by SENES Flamenco.

-Refunds are granted at the sole discretion of SENES Flamenco. An administration fee of $50 will apply to all refund requests under exceptional circumstances.

4. Cancellation Fees

All bookings cancelled forfeit a non-refundable deposit (50%). Any cancellation within 14 days of the performance date will incur 100% of the full performance fees except under exceptional circumstances including family death, terminal illness and accidents. All refund applications must be made in writing with supporting documentation is required to process your claim including a medical certificate.

5. Performance Risks & Show Cancellations

SENES Flamenco reserves all rights to cancel any performances at the venue due to: personal threat to performers including health risks, violence, health hazards & natural disasters for any member of the ensemble associated with performance venue and/or environment.

In the case of sudden illness, SENES Flamenco reserves the right to cancel bookings; a waiver of standard booking policies apply.
